Who we are
C&K Realty Pty Ltd (ABN 63 672 069 279 · ACN 672 069 279 · QLD Real Estate Licence 4736294) (“C&K Realty”, “we”, “us”) provides buyer’s agency and residential property management services in Queensland. This policy explains how we collect, use, disclose and protect personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. It applies to our clients, property owners, tenants and rental applicants, website visitors and anyone else we deal with.
What we collect
- Contact details — name, phone number, email and postal address.
- Identity information — such as date of birth, identity documents and verification results, including for customer due diligence under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).
- Property owners — property and ownership details, bank account details for rent disbursements, and your instructions and correspondence with us.
- Tenants and rental applicants — the information in your rental application (for example employment, income, rental history, references and identification), tenancy records, rent payment history, and repair and inspection records, including photographs of the property taken during inspections.
- Buyer’s agency and property purchase clients — your property brief, budget and finance position, and other information we need to act for you in a purchase.
- Consultations — notes of our meetings and calls with you and, with your consent, recordings and transcripts of them.
- Enquiries — what you send us through our website forms, email, phone, messaging or social media.
We only collect sensitive information where it is reasonably necessary and you consent, or where the law requires or allows it.
How we collect and hold it
We collect personal information directly from you — through forms, applications, emails, calls and meetings. We may also collect it from others where you have agreed or the law allows: your referees and previous landlords or agents, co-owners, your conveyancer, solicitor or broker, the online rental application platforms you use to apply, and public records such as property ownership records. With your consent, we may record consultations and calls, and use transcription and AI tools to prepare notes from them.
We hold personal information in electronic records — property management, accounting, document-signing and cloud storage systems — and take reasonable steps to limit access to the people who need it to do their work.
Why we use it
- To provide our services — acting as your agent, managing tenancies, putting rental applications to owners for decision, collecting and paying rent, arranging repairs and inspections, lodging bonds and carrying out property purchases.
- To meet our legal obligations, including under the Residential Tenancies and Rooming Accommodation Act 2008 (Qld), the Property Occupations Act 2014 (Qld) and the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).
- To respond to your enquiries and, where you have agreed or the law otherwise allows, to send you property information and updates. You can opt out at any time — use the unsubscribe option in our message or contact us using the details below.
- To run and improve our business.
Who we disclose it to
- The other parties to a tenancy or purchase, to the extent needed — for example, giving an owner the information they reasonably need to decide on a rental application.
- Tradespeople and contractors — for example, a tenant’s contact details so a repair can be arranged.
- Government bodies and regulators where required or authorised by law — such as the Residential Tenancies Authority, the Queensland Civil and Administrative Tribunal and AUSTRAC.
- Local councils, water service providers and insurers — for example, to manage rates and water accounts for an owner’s property, or to handle an insurance claim.
- Professionals involved in your matter — such as conveyancers, solicitors, brokers and building and pest inspectors.
- Service providers who host or process information for us — software, cloud storage, document-signing, accounting, communication and AI tools.
- Anyone else you agree to, or as required or authorised by law.
We do not sell personal information.
Overseas disclosure
We are likely to disclose personal information to overseas recipients — mainly software and cloud service providers that host or process information for us, including providers in the United States.
Security and retention
We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. We keep it for as long as we need it for the purposes above or as the law requires — for example, we keep customer due diligence records for at least 7 years. When we no longer need it and the law does not require us to keep it, we take reasonable steps to destroy or de-identify it.
Our website
When you use a form on this website, we receive the details you enter (such as your name, email, mobile and message) and store them in our cloud workspace to respond to you. Pages that embed content from other websites (such as YouTube videos) behave as if you had visited that website, which may collect data about you and use cookies.
YouTube API Services
C&K Realty uses YouTube API Services in an internal content-management tool that operates exclusively on our own YouTube channel. By interacting with our YouTube channel or content, you also agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms).
Our use of information received from YouTube API Services adheres to the Google Privacy Policy (http://www.google.com/policies/privacy).
Data we access: our tool accesses our own channel’s video metadata and aggregate analytics (views, watch time), and the comments posted on our own videos — including each commenter’s public display name and channel ID — so that we can read, reply to and moderate them. It does not access viewers’ private account information. We do not sell this data or share it except with the service providers described in this policy.
Data retention and deletion: aggregate analytics are stored locally for internal weekly reporting and are refreshed weekly; stored API data older than 30 days can be deleted on request. If you have authorised our tool to access your Google/YouTube data, you may revoke that access at any time via Google security settings (https://myaccount.google.com/permissions). Comment records are kept only as long as we need them to manage our channel, including any moderation record. If you have commented on our videos and want us to delete our records of your comments, or have any other privacy question, contact charley@candkrealty.com.au.
Access and correction
You can ask to access the personal information we hold about you, or ask us to correct it, by contacting us using the details below. We will respond within a reasonable time, usually within 30 days. If we refuse, we will give you written notice of our reasons (except where it would be unreasonable to do so, given the grounds for refusing) and of how you can complain.
Complaints
If you have a concern about how we have handled your personal information, please contact us in writing using the details below. We will acknowledge your complaint and aim to respond within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at www.oaic.gov.au or on 1300 363 992.
